1. Amendment to Covenants, Conditions, and Restrictions

  • We have reached the minimum threshold needed in order to amend the CCR’s
    • We will continue to gather signatures as every homeowner has the right to sign, and in order to prove the overwhelming will of the majority.
  • As of Monday, Aug. 25, 2025 – the amended CCR’s have been recorded with Richland County and are immediately in effect.
  • David Wright gave his thanks to all who have offered support and volunteered, giving special thanks to JJ Gentry and Sarah Lewis. “This was an outpour of love from everyone”

Floor was then opened to questions from residents-
Q. The amendment has been filed, now what happens?
A. It goes into effect as of the day of record. Homeowners who currently rent their homes will have 30 days to submit their rental leases in order for Town and Country to have them on file, if they have not already done so.

Q. Will the townhomes be sold to individual homeowners, and not as rentals?
A. The amendment is not a blanket prohibition on the homeowners’ ability to rent, they must do so under the new guidelines.

Q. What is meant by the guideline that states a minimum of 1 year occupancy from the homeowner in order to rent their home?
A. They must physically live in the home for a minimum of one year.

Q. How many townhomes have closed?
A. We only know of 3

Q. Can they argue that “under contract” would allow the buyer the rights of ownership?
A. By definition, it must be the homeowner of record, a contract to purchase does not qualify the buyer as an owner.

Q. We still don’t have a rental cap, should we pursue this in the future?
A. We can always look to implementing a cap in the future. It was discussed and decided that it would still allow for a great many of the townhomes to be used as rentals, and would not accomplish our goal.

Q. Are there any more parcels of land that the original developer (Seaboard) can sell to be built on?
A. Yes, there are 14 acres that they are still looking to sell. The PUD for the lot is for much larger homes, where the PUD for the Point was always for townhomes.

Q. What kind of traffic study has been done?
A. We are in conversations with the city.

Q. What are the “reasonable fees” mentioned in the amendment?
A. Cost of filing for rental permits with the city, and such will be placed on the landlord, so not to be a cost burden to homeowners.

Q. How will this affect the current rate of HOA dues?
A. There will be a financial influx due to the additional fees paid, but we will also incur more cost. Both will be considered at the next budget meeting to have a better idea.

2. Pool-

  • Will be closing Sept. 28.
  • Many of residents’ concerns have been resolved by either turning off fobs or calling the police.
  • Will the influx of dues from the Point allow for attendants to be in the budget next season?
    • Will be discussed over the budget meeting.

3. Fence (status) –

  • There has been a contract signed and deposit made for the work to be done earlier this year. Vendor is claiming that tariffs have caused them delays in getting the materials.

4. Ponds –

  • Pond management company, AMS Outdoors, was hired the beginning of summer.
    • They will be inspecting twice a month, balancing the pH, fertilizing, and treating for algae.
    • Overall the health of the ponds is struggling due to the run off from the developers, and will take a great deal of care in order to salvage them.

5. Tennis Courts –

  • We have added 2 temporary pickle ball courts, please use them accordingly. Consideration to convert one of the courts to a permanent pickle ball court will be given at the budget meeting.

6. Other –

  • All the street lights are working. If you see one that is out, please contact the Board with the light number.
    • If a light is out (or a row of lights) near the new development, it is most likely from damages caused by them.
  • Please be aware of deer on Lost Creek while driving.

7. Budget meeting –

  • If you have a project or a suggestion for the Board that you would like to see
    budgeted for next year, please email the Board prior to the scheduled budget
    meeting in October.
